1. Who we are

Pocket Preserve (Android package com.yashasystems.game.pocketpreserve) is made and published by Yasha Systems LLC, 30 N Gould St, Sheridan, WY 82801, USA. "The game" means the app, its updates and the content it downloads.

2. Accepting these terms

By installing or playing the game, you agree to these terms. If you do not agree, please do not play, and uninstall the game.

The game is for players 18 and older. By playing, you confirm that you are at least 18. The rules of the store you got the game from (Google Play or the App Store) also apply.

3. Your licence to play

We give you a personal, non-exclusive, non-transferable and revocable licence to install the game and play it on devices you own or control, for your own non-commercial use. The game, its puzzles, art, music and code belong to us or our licensors. You may share screenshots and videos of your play, but you may not copy, sell, rent or redistribute the game itself.

We may suspend or end this licence if you seriously or repeatedly break these terms. Where we can, we will tell you first and give you a chance to fix the problem. You can stop playing and uninstall the game at any time.

4. Virtual items and currencies

The game has virtual currencies and items, such as Seeds, Energy, Moonstones, Golden Moonstones, Pawprints, skins and decorations. You can earn them by playing, and some can be bought.

• They have no cash value. They cannot be exchanged for real money, goods or anything outside the game, and cannot be sold, traded or transferred to another player.
• When you get them, whether you earn them or buy them, you receive a licence to use them in the game. You do not own them.
• A wish in the Moon Pond gives a random skin. The odds are shown in the game before you wish.
• We may change prices, rewards, odds and how items work, to keep the game balanced and fair. We will not take away items you have already bought without a fair reason, such as a mistake in delivery, a refund or a breach of these terms.
• Items are lost if the game ends (section 8), or if you lose your progress, for example by clearing the app's data without a cloud save. Purchases that can be restored, such as Remove Ads, come back with Restore Purchases.

5. Purchases and refunds

Purchases are made through Google Play (the App Store on iPhone) and are subject to that store's terms. Prices are shown in the game before you buy. Most items are delivered at once; currencies are used up when they are delivered.

Refunds are handled by the store under its refund policy. We cannot issue store refunds ourselves. If a refund is granted, we may remove the item or currency it paid for. If something you paid for did not arrive, see Support, section 1.

Nothing in these terms limits the rights your local consumer law gives you, for example if an item is faulty or not as described.

6. Ads

The game may show ads. Rewarded ads are always optional: you choose to watch one in exchange for a reward, and a reward depends on the ad finishing. Buying "Remove Ads" removes interstitial ads (the ones between levels); rewarded ads stay available for anyone who wants them. Ads come from third parties, and we are not responsible for what they advertise.

7. Fair play

To keep the game fair, you agree not to:

• cheat, or use bugs or exploits to gain items, currencies or scores, and you agree to tell us about any you find;
• modify, decompile, reverse-engineer or tamper with the game or its saves, except where the law allows this;
• use bots, scripts or other automation to play, or interfere with ads or purchases;
• attack, overload or try to get unauthorized access to our services;
• use the game in a way that breaks the law or these terms.

If you do, we may remove items or scores gained unfairly, reset leaderboard entries, or end your licence (section 3).

8. Availability and changes to the game

We keep improving the game, so content, features, events and prices may change. The game may sometimes be unavailable, for example during maintenance or while you are offline. We may stop offering the game, or some of its features, at any time. Where reasonable, we will give at least 30 days' notice in the game or in the store listing before we end the game or remove a paid feature.

9. Privacy

Our Privacy Policy explains what data the game handles, why, and the choices you have. It is part of how we provide the game, but it is a separate document.

10. Disclaimers

We work hard to make the game enjoyable and reliable, but we provide it "as is" and "as available". As far as the law allows, we do not promise that it will always be available, free of errors, or suitable for any particular purpose. If you live in the EU, the UK, Turkey or another place whose consumer law gives you rights that cannot be waived, such as the right to digital content that works as described, you keep those rights.

11. Limitation of liability

As far as the law allows, we are not liable for indirect or unforeseeable losses, or for lost profits, lost data or lost progress caused by events outside our reasonable control. As far as the law allows, our total liability to you is limited to the amount you paid us for the game and its purchases in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer law.

12. Governing law

These terms are governed by the laws of the State of Wyoming, USA. If you are a consumer, this does not take away the protection of the laws of the country where you live that cannot be waived, and you can bring a claim in the courts where you live if your local law allows it. Please contact us first: most problems can be solved quickly by e-mail.

13. Changes to these terms

We may update these terms, for example when the game changes or the law requires it, and we will change the date at the top. For significant changes we will tell you in the game or in the store listing's release notes before they take effect. If you keep playing after that, you accept the new terms; if you do not agree, you can stop playing.
